Peter Potterfield Book Tour Sweepstakes Official Sweepstakes Rules 1. Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN.THIS SWEEPSTAKES OPEN ONLY TO LEGAL RESIDENTS OF THE U.S. (EXCLUDING RESIDENTS OF FLORIDA, NEW YORK AND RHODE ISLAND) AGE 18 OR OLDER. IF YOU ARE NOT A LEGAL RESIDENT OF THE U.S. OR AGE 18 OR OLDER, YOU ARE NOT ELIGIBLE TO WIN A PRIZE, AND REI RESERVES THE RIGHT NOT TO AWARD PRIZES TO ENTRANTS WHO RESIDE IN OTHER JURISDICTIONS. To be eligible to win a prize, entries must be completed and received by REI in the format designated below. Online sweepstakes entries will not be accepted. Directors, officers and employees of REI, Cascade Designs, Kelty, Outdoor Research and any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate families of each are not eligible to win any prizes. All applicable federal, state and local laws and regulations apply. Offer void in Florida, New York, Rhode Island, Puerto Rico and where prohibited. 2. Disclaimer. REI, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, illegible, incomplete or damaged entries; (b) any Sweepstakes disruptions, injuries, losses or damages caused by events beyond the control of REI; or (c) any printing or typographical errors in any materials associated with the Sweepstakes. 3. Sweepstakes Period and Location; How to Enter.
The Sweepstakes runs from 10:00 a.m. (PST) February 15, 2005, to 9:00
p.m. (PST) April 13, 2005 (the "Deadline"). However, entries will be
accepted only at the locations specified below on the corresponding
dates specified for each location. All entries must be received by the
Deadline to be eligible to win a prize. To enter the Sweepstakes,
complete and submit an entry form in the REI store location on the
corresponding date set forth below. Online sweepstakes entries will not
be accepted. By entering the Sweepstakes you consent to being placed on
a mailing list for promotional and other materials from and about REI.
No mechanically or electronically reproduced entries will be accepted.
Limit one entry per person, regardless of location of entry. 4. Prizes. One (1) Grand Prize will be awarded, consisting of the following: REI Adventures' Mt. Rainier Backpacking trip for the winner and one guest (the "Trip"). Grand Prize Trip includes: participation in REI Adventures' Mt. Rainier backpacking trip for two people, double occupancy accommodations (5-nights in a tent, 1-night at a hotel/lodge); all meals from dinner on Day 1 through breakfast on Day 7; guides and leadership; group gear (tent, stoves, fuel, cooking equipment, maps, etc.); group transfer from Sea-Tac airport to/from trailhead; and up to $500 per person to be applied toward economy airfare for the winner and the winner's guest when air travel is booked through REI Adventures (see details, below). Approximate retail value of the Grand Prize Trip is $3,400 (if air travel booked through REI Adventures). Three (3) second place prize packages will also be awarded: Outdoor Research (OR) Prize Package includes one OR Seattle Sombrero, one pair of OR Verglas Gaiters, one pair of OR Windstopper Gripper Gloves, one pair of OR Snowline Mitts, one OR Windstopper Alpine Hat, one OR Celestial Parka, one OR Celestial Pants and one OR Polaris Jacket (approximate retail value of OR Prize Package is $720.00); Cascade Designs Prize Package includes one Thermarest ProLite 4 Sleep Pad, one MSR Superfly with autostart Stove, one MSR MIOX Water Purifier, one Duralite Gourmet Cookset, one Platypus Tera hydration pack, one Packtowl, one Alpine Kitchen Set and one Prolite 4 Stuff Sack (approximate retail value of Cascade Designs Prize Package is $505); and the Kelty Prize Package includes one Kelty Illusion 3500 Pack, one Kelty Lightyear 3D Sleeping Bag and one Kelty Gunnison 2 Tent (approximate retail value of Kelty Prize Package is $399.00) (collectively, the "Prizes"). Odds of winning a prize depends on number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. All prizes will be awarded. Prizes returned as undeliverable or otherwise not claimed within 10 days after delivery of notification will be forfeited and awarded to an alternate winner selected by a second random drawing from all remaining eligible entries. Prizes are not transferable, are not eligible for the REI member refund, and may not be used with any other promotional discount. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that REI reserves the right to substitute a prize of comparable or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). 5. Conditions of Grand Prize Trip. Dates of travel are subject to Trip availability, but the Trip must be completed by December 31, 2006. The Trip is for the winner and one guest only. Winner and Winner's guest must take the same Trip at the same time. Winner's guest must be at least 18 years of age prior to winner taking the Trip unless winner is the parent or legal guardian of the guest. Winner is responsible for airfare, except that if the winner arranges his or her air travel through REI Adventures, the winner is entitled to an amount of up to $500 each to be used for the winner's and winner's guest's airfare in connection with the Trip. In the event that the airfare booked through REI Adventures is greater than $500 each, the winner and/or winner's guest shall be responsible for the difference; provided, however, in no event shall winner or winner's guest be entitled to any cash, credit or rebate in the event that the airfare booked through REI Adventures is less than $500 each, nor shall winner be entitled to use any of such amount for airfare for any other person (other than guest). Except as otherwise expressly identified above, winner is further responsible for ground transportation to and from the airports and group meeting location, all meals (except as identified above) and all other expenses that winner incurs in connection with the Trip, including, but not limited to, the cost of any rental gear (such as backpacks, sleeping bags, etc.), any additional hotel nights, insurance of any kind, excess baggage charges or airport taxes (if any), alcoholic beverages, items of a personal nature such as tips to guides, and all applicable passport, visa, and entry/exit fees. By accepting prize, winner agrees to comply with all requirements and abide by all rules of REI Adventures in connection with the Trip, including but not limited to signing a liability release. Actual features of the Trip awarded shall be selected by REI Adventures in its sole discretion and may vary from photos used in print, REI in-store advertising, and in electronic and web banner advertising including the REI or REI Adventures web sites. The Trip description set forth in these Official Rules is current as of the Sweepstakes period for trips taken during the year 2004; however, REI and REI Adventures reserve the right to modify and/or update Trip information and logistics for Trips taken during the year 2005, and/or as REI or REI Adventures deem necessary. Additional Trip information and scheduled 2005 Trip dates may be found at www.reiadventures.com. 6. Selection of Prizes. Actual model, color, accessories and features of the Prizes shall be selected by REI in its sole discretion and may vary from photos used in print, REI in-store advertising, and in electronic and web banner advertising including the REI web site. 7. Selection and Notification of Winners. Winners will be determined by a random drawing from all eligible entries gathered between February 15 and April 13, 2005, in all participating stores, to be held at REI Headquarters, 6750 S. 228th St., Kent, WA 98032 on or about April 25, 2005. Winners will be notified by telephone, mail or e-mail by April 29, 2005. To claim a prize, a winner should follow the instructions contained in his or her notification. 8. General Release. By entering the Sweepstakes, you release REI, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Sweepstakes or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. 9. Use of Winners' Name, Likeness, etc. Except where prohibited by law, entry into the sweepstakes constitutes permission to use winners' name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winners may be required to execute a consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. 10. Affidavit and Release. As a condition of being awarded any prize, winners will be required to execute and deliver to REI a signed affidavit of eligibility, acceptance of these Official Rules and release of liability. 11. Winners' List; Rules Request. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of REI, which are final and binding in all respects. REI reserves the right to suspend or cancel the Sweepstakes or any entrant's participation in the Sweepstakes should unauthorized human intervention or other causes beyond REI's control affect the administration, security or proper play of the Sweepstakes or REI otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned, in which event all prizes will be awarded via a random drawing from among all eligible entries received prior to cancellation. Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to REI, the Sweepstakes or any other entrant (in each case as determined in REI's sole discretion) are subject to disqualification from entry into the Sweepstakes. REI reserves the right to prohibit the participation of persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes.
